The Illinois Workers' Compensation Law

In Illinois, as in many states, most employers are required by law to have workers' compensation insurance for their employees. The employer may purchase the coverage from a private insurance company or may choose to self-insure (pay for any claims directly).

As a general rule, workers' compensation laws require that employers provide full medical benefits to employees with work-related injuries. The statute provides the formula for calculating weekly payments for different types of disability, including:

  • Temporary total disability (TTD)
  • Permanent total disability (PTD)
  • Permanent partial disability (PPD)

With a temporary disability, payments continue for the length of the disability. If the disability is permanent, the payments may continue for up to 500 weeks (PPD) or for life (PTD). Physical and vocational rehabilitation can be paid for under workers' comp and a death benefit is also provided, if needed.
