Volkswagen Emissions Scandal Affects Hundreds of Thousands

As far back as 2009 automaker, Volkswagen ("VW"), has allegedly been using a computer software hack to fool the U.S. Environmental Protection Agency ("EPA") regarding vehicle performance and emissions levels in several models that utilize VW's turbocharged direct injection (TDI) diesel motor. In September. 2015 the emissions scandal broke when the EPA allegedly learned that VW was using computer code in its 2.0 and 3.0 litre TDI diesels that gave "false" data when the affected vehicles were undergoing emissions testing. The affected vehicles currently number over 500,000 and include several models of VW, Audi, and even Porsche, who was supplied 3.0 litre TDIs from VW for use in one of its SUVs.

The scandal has led to a drastic drop in demand for the affected vehicles which has directly affected the values of the affected vehicles. As there is currently no "fix" for the affected vehicles, it remains to be seen what the long-term affect on consumers and owners of the affected vehicles will be. One thing is for certain, however, owners have undoubtedly been damaged by VW's alleged fraud. Consumers who purchased the affected TDI diesel models paid a "premium" for the vehicles, and have been allegedly misled as to vehicle performance, fuel efficiency and economy, and misled as to the vehicle's environmental impact. The affected vehicles are alleged to contribute between 10-40 times over allowable emissions levels of nitrogen oxides and hydrocarbons during normal operation. Considering that these vehicles were heavily marketed to consumers as "green" and "environmentally friendly", those numbers are concerning to say the least.
