Out-of-State Workers’ Compensation

Author Todd A. Strong

People who do not live or work in Illinois may be able to file a workers’ comp claim and obtain workers’ comp benefits under Illinois laws. If you have been involved in a work accident and have a connection with the state, you should talk to a lawyer at our firm to determine if you should file for benefits here in Illinois. We can service out-of-state clients via email, fax, and our toll-free numbers. We have a network of experts that we can access throughout the country to help establish an Illinois workers’ compensation claim.

Strong Law Offices has office locations in Peoria, Bloomington, Springfield, and Chicago. We represent clients throughout the entire state in workers’ comp and personal injury claims. We are a firm that is exclusively focused on representing the injured worker. Our attorneys never represent the insurance company or large corporations.

Out-of-State Workers' Comp Attorneys

We represent workers who do not live or work in Illinois but have been injured in Illinois or have some connection to Illinois jurisdiction in a workers' comp case. For example, we represent airline workers who have been injured on the job (even though the company is not based in Illinois). Another example includes contract workers who were hired to work in Illinois, or workers who work for a company that is headquartered in Illinois.

It is essential to investigate the last act required to complete the hiring process. We obtain employment records, personnel files, human resource documents, and union contracts to establish that the employment relationship was created in Illinois.

If we can establish that either the accident occurred in Illinois or if the contract for hire occurred in Illinois, the Illinois Workers' Compensation Commission will have jurisdiction to hear the Illinois claim.

This means that Illinois can have jurisdiction for work accidents that occur in other states or other countries. This is very common in the trucking industry and airline industry. Traveling employees who travel away from their home base are also covered for workplace accidents out of state while traveling.

Out-of-State Workers' Compensation

Illinois workers' compensation benefit laws are very progressive compared to other states and in many ways favor the injured worker — not the insurance company. It is likely in your best interests to work with an Illinois attorney to find out if you benefit most from filing a claim in Illinois. This is where Strong Law Offices steps in.

Our Illinois attorneys for out-of-state workers are readily available over email and by phone, and will handle much of your claim from Illinois so you can return home.
